Thank you for choosing the Caravan and Motorhome Sales Services offered by We Buy Any Motor Caravan Ltd, with business address located at Bretby Business Park, Ashby Road Burton, United Kingdom, trading as ‘CMS Auctions’ the CMS Auctions services is accessible at www.caravanandmotorhomesales.co.uk.
This Terms and Conditions (“Terms”) governs both our services (“services”), to users (“You”) and your use of the CMS Auctions website (collectively, the “Platform”), and your use of any contents, product, and service, collectively, “Services”) made available via the Website.
These Terms constitute a contractual agreement between you and CMS Auctions. Caravan and Motorhome Sales Ltd will be referred to within this document as (“we”, “our”, or “us” “CMS Auctions”) and you within the document will be referred to as The User (”the “Buyer”). We reserve the right at all times to remove or modify any part of this Terms unilaterally. We shall notify you by e-mail or via the Service about the amended and restated Terms to ensure that you stay informed of any such amendments and restatements. Your use of the Service after the date of notification or the effective date of changes indicated in the notification shall mean your acceptance of the amended and restated Terms, unless you accepted them otherwise earlier.

2. Account Registration
To enjoy the full function of our service, you will be required to create an account on the website and become a registered user, as part of the registration process, you will be mandated to submit certain personal information. Our Privacy Policy governs how we deal with your personal information. Please review the Privacy Policy carefully to understand our practices.
You are responsible for any activity that occurs with your account credentials so you are required to keep your account credential secure and out of reach from third-parties user.
3. What We Do for You
We provide online vehicle auction content on our website. The website is only a means to view online vehicle auction content. To participate in vehicle auction sales you agree to register with the Auction merchant website British Car Auctions Limited accessible at {https://www.bca.co.uk/} Please see their Terms and Conditions.
CMS Auctions is not an online auctioneer neither do we provide online auction service. We merely provide online information and content linked from the British Car Auctions Limited events as a form of advertising. Therefore, we are not a party to the contract for sale and purchase entered into between you, the BCA. You agree that we are not in control of the information made available by British Car Auctions Limited which you access via the CMS Auctions website. We cannot therefore make any representations, warranties or guarantees in connection with what the auctioneer may offer for sale through the website.
We do not charge you for your general use of the website (however there are some services via BCA which you may wish to sign up to that require a subscription fee and which may be subject to additional terms and conditions).
4. Third-Party Services
The CMS Auction Service may contain links to third-party Services e.g. the {British Car Auctions website} which are not owned or controlled by CMS Auctions. CMS Auctions have no control over, and assumes no responsibility for, such Platform and online auction services. Be aware when you leave the CMS Auction website; we suggest you read the terms and privacy policy of each third-party Platform and online service that you visit.
5. The CMS Reward
We offer CMS Rewards to user’s as monetary vouchers depending on how many motorhomes they buy via the CMS Auction stock via the BCA Auction website within 12 month period.
Only Users’ who made more than 5 vehicle purchase, within (6) six months with proof of purchase receipts to confirm you have bought the CMS vehicles via British Car Auctions. Each winner will receive monetary vouchers. The value of each voucher shall be depended on the number of CMS Auction vehicles you have purchased from British Car Auctions between advertised dates.
Qualifying Users’ agree to provide Invoices as proof of purchase within 14 days of the closing date advertised.
Rewards are as follows:
a. 5 vehicles will receive £500,
b. 10 vehicles will receive £1,000,
c. 20 vehicles will receive £2,000,
d. 30 vehicles will receive £4,000,
e. 40 vehicles will receive £8,000,
f. 50 vehicles will receive £16,000.
6. Copyright and trademarks
All the content on the Platform, including service marks, trade marks, designs, code, images, advertising content, advertiser identities, logos, property content, product information, general content, pricing data, advertisements, advertiser details, user interface design, software and all other forms of media or information published on the site from time to time (the “Content”) is owned or otherwise licensed by CMS Auctions unless otherwise indicated, and, where applicable, is protected by local and international law on copyright and intellectual property.
You agree not to infringe on any of the intellectual property rights in the Content or any other material owned by third parties, and undertake not to reproduce the materials without the express permission in writing of the owners of the intellectual property rights. 7. Disputes and Complaints
The Platform is merely a platform to facilitate the buying of vehicles by introducing Users to the BCA Auction content/services. CMS Auctions will not, and is not obliged to assist, in any disputes between any User (including any disputes between the BCA and any Buyer in the context of Auction Vehicles).
8. Data protection
The User and CMS Auctions warrants to the other that it shall comply with the provisions of the Data Protection Legislation; in so far as the Usage Agreement relates to or involves the processing of Personal Data.
The User acknowledges and agrees that in entering the Usage Agreement, the User will provide CMS Auctions with and CMS Auctions may collect certain Personal Data relating to the User and/or employees, consultants and/or contractors engaged by the User. This Personal Data will be processed in accordance with CMS Auctions’s Privacy Policy and may be used for a number of purposes as further detailed therein. CMS Auctions’s Privacy Policy can be found at www.caravanandmotorhomesales.co.uk/privacy.
Furthermore, the User acknowledges that CMS Auctions are the Data Controller for any Personal Data processed as part of the User’s CMS Auctions account creation and usage.
9. General Provision
After properly registering for the CMS Auctions Service, we grant you a personal, non-exclusive, fully revocable, non-assignable, non-transferable, limited right to use and access our services as permitted by us. As a user, you do not receive any ownership interest in the platform; you merely receive the right to use and access the Platform as provided by us. All rights not explicitly granted are reserved for CMS Auctions. You agree to abide by the following restrictions listed below:
b. Waiver. No forbearance or delay by either party in enforcing its respective rights will prejudice or restrict the rights of that party, and no waiver of any such rights or of any breach of any contractual terms will be deemed to be a waiver of any other right or of any later breach.
c. Assignment/sublicensing. The User may not assign or sublicense the Agreement or any benefits or interests arising under these Website without the prior written consent of relevant Website Operator.
d. Governing law and jurisdiction. These Website Terms (and accordingly all visits to the Website) shall be governed by the law of England and Wales and the parties submit to the exclusive jurisdiction of the English Courts. This is without prejudice to the CMS Auctions right and that of its affiliates to commence proceedings anywhere in the world relating to the protection of its Intellectual Property Rights or those of its Licensors.
10. Termination
CMS Auctions reserves the right to immediately suspend or terminate its Service to any User without warning and notice for violation or breach of any of the agreement in this Terms of Service.

CMS Auctions encourages you to share your reviews and feedback with us, and we promise to respect your feedback irrespective of the outcome, for it helps us improve on our services and make us serve you better. By submitting feedback, you are granting us an irrevocable, perpetual, non-exclusive, transferable, fully-paid, worldwide license (with the right to sublicense freely) to use, copy, modify, publicly perform, publicly display, reformat, translate, syndicate, republish, excerpt (in whole or in part) and distribute feedback we receive from you for any purpose, including business, commercial, marketing, advertising, or otherwise.
